Purpose
This Legal Notice governs access to, browsing and use of the website www.ewala.es (hereinafter, "the Website"), made available to users by Ewala in compliance with the LSSICE.
Visiting and using the Website confers the status of user (hereinafter, the "User") and implies full and unreserved acceptance of all the conditions set out in this Legal Notice, in the Privacy Policy and in the Cookie Policy, which together make up the complete legal information of the Website.
Ewala reserves the right to modify at any time the presentation, configuration, content and conditions of access and use of the Website. The User should read this Legal Notice carefully each time they access the Website, as its terms may change. If the User does not agree with the terms set out, they must refrain from browsing and using the Website.
Intellectual and industrial property rights
Ewala is the owner or, where applicable, holds the corresponding licences over the intellectual and industrial property exploitation rights of the Website and of the elements it contains.
All content of the Website, including but not limited to images, photographs, documents, software, texts, graphics, trademarks, logos, distinctive signs, colour combinations, structure and design (hereinafter, the "Content"), is the intellectual and industrial property of Ewala or its licensors. In accordance with Royal Legislative Decree 1/1996, of April 12, approving the consolidated text of the Spanish Intellectual Property Law, the reproduction, distribution and public communication, including making available, of all or part of the Content for commercial purposes, in any medium and by any technical means, without the prior express authorisation of the owner is expressly prohibited, except for uses covered by the limits provided by law.
The User shall refrain from removing, altering, circumventing or tampering with any protection device or security system installed on the Website.
Links to third-party websites
The Website may contain links or hyperlinks providing access to independent third-party websites. Ewala exercises no control over those websites or their content and therefore accepts no liability for them.
The inclusion of links to third-party sites does not imply approval, association or endorsement by Ewala. Ewala does not guarantee that the links are accurate at the time of access or that the linked sites are operational at all times.
Ewala shall not be liable for the information the User accesses through such links, unless it has actual knowledge that the activity or information they lead to is unlawful or infringes the goods or rights of a third party eligible for compensation, in which case it will act diligently to remove or disable the corresponding link.
Terms of use
The User undertakes to make correct use of the Website in accordance with applicable law and this Legal Notice.
Use of the Website for purposes harmful to the goods or interests of Ewala or third parties, or that in any other way overload, damage or disable the networks, servers and other computer equipment or software products and applications of Ewala or third parties, is expressly prohibited.
In particular, and without prejudice to the foregoing, the User shall refrain from carrying out on the Website or on the systems that support it any penetration testing, vulnerability scanning, port scanning, reverse engineering or similar activity without the prior, express and written authorisation of Ewala, as provided in articles 197 bis and 264 et seq. of the Spanish Criminal Code.
The User shall be liable to Ewala or to third parties for any damages that may result from breach of these obligations.
Disclaimer of liability
Ewala does not guarantee that the content of the Website is free of errors or permanently up to date, although it declares that it will take reasonable measures to correct errors, update content and keep the Website working properly.
Ewala is not responsible for:
- Damages arising from the presence of viruses, malware or any other harmful computer element on the Website or on the server that provides it. It is the User’s responsibility to have adequate tools to detect and protect against harmful software.
- Damages arising from failures, interruptions or disconnections in telecommunications networks, power supplies or any other third-party service affecting the availability of the Website.
- The truthfulness, accuracy, suitability or timeliness of content provided by third parties, Ewala being exempt from any contractual or non-contractual liability towards Users who make use of it.
Educational, technical or research content published on the Website is purely informative and does not constitute professional advice or a guarantee of results. Its application by the User is at the User’s sole responsibility and creates no contractual relationship with Ewala.
If the User becomes aware of unlawful content or content that may infringe third-party rights, the User must notify Ewala immediately using the contact details given in section 1, so that it can take appropriate measures. Receipt of such a notice does not constitute, under the LSSICE, actual knowledge of the activities or content indicated by the sender.
Data protection
In accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD), all personal data provided while using the Website will be processed as set out in the Privacy Policy, accessible through a link at the bottom of the Website.

Governing law and jurisdiction
This Legal Notice is governed by Spanish law.
For the resolution of any dispute arising from access to or use of the Website, the parties submit to the Courts and Tribunals of Gijón (Spain), except where applicable regulations impose a different jurisdiction, in particular consumer and user protection regulations.
Ewala states its willingness to resolve any dispute amicably beforehand.
